Next Tuesday, May 31, 2022 is the deadline to file the ordinary declaration of the Transparency and Beneficial Ownership Registry without penalties, in accordance with Resolution No. DGT-ICD-R-013-2022 "Addendum to the Joint Resolution of General Scope for the Transparency and Beneficial Ownership Registry No. DGT-ICD-R-06-2020".
Such Resolution extended the deadline for filing the ordinary declaration of the 2022 term of the Registry of Transparency and Beneficial Owners (RTBF) up to and including May 31, 2022, due to the temporary suspension of the systems used by the Ministry of Finance, that is to say, next Tuesday.
The Resolution made it clear that such extension is exceptional and that for subsequent years, individuals and trusts will be required to file the tax return in April of each year.
It is important to reflect on this obligation, how expensive it has been for companies and groups of companies to comply with it, and it is also important to reflect on the sensitivity of this information once it is all collected in one place, given the weaknesses demonstrated by our institutions (without being able to say all of them) to safeguard our data, that the data is ours, let there be no doubt about it.
And this reflection is important because pretending that by making everyone comply with this obligation, organized crime would stop its criminal activity is unrealistic. On the contrary, by having the data of the owners of the companies and trusts in one place, organized crime has the most difficult task of all: to know their victims well, knowing their business organization and their corporate relationships, created to generate business and produce wealth.
And then the other thing: if by making this registry we were going to improve collection by attacking fraud, it is worth asking the authorities, how they have used this information and what different or overwhelming results has it generated having it at their disposal when they already had sufficient tools in the laws to be able to investigate fraud, for example, access to bank accounts, the provision of information and the powers of control, ample in our environment.
In an environment of distrust like the current one, where we still do not know what happened to the information in our statements, where so many weeks after Conti's attacks, we are not clear about the damage done, the path to follow or future prevention measures, it is worth asking whether it is wise to continue gathering all our information in a single place, which we also know is not secure.
